Guys if you see the advert below, what do you assume your getting a set of cam pulleys for the intake and exhaust, or just the one pulley??

Added a pole to make things easier. I ordered this off negun and just got the one. I am currently in a dispute with them but just want some opinions etc etc.

Toda - Adjustable Cam Pulleys
Honda B16A /B16B /B18C Cam Pullys IN & EX - Quantity 1 14211-B16-001

very misleading advert, i was gonna say pair but then read quantity part near end

says cam pulleyS IN & EX, sounds like you got cam pulley, in OR ex.

I thought two because it says pulleys and IN & EX which would both indicate a pair to me but then the quantity of 1 makes it very confusing.

I would assume both as it says 'pulleys' and then 'IN & EX' which I would assume to be sold as a pair and therefore be 1 in quantity.

Intake and exhaust, quantity 1 sounds like your getting 1 pair of pulleys, it really pisses me off when people do that, like spoon selling brake parts singularly and not making it obvious.

with that advert you would expect to get both the IN and EX pullys.
very misleading, but i expect that in a dispute you would be the party in favour because the header of the advert states Cam 'Pullys' IN '&' EX meaning that you should recieve both of these as a package.

yeah same opinion as above defo makes it out to be 1 set of both pullys, have delt with nengun before with no issues but its defo misleading the way its worded

If it uses a plural to describe the item for sale, you are legally entitled to what they advertise, (which is more than one pulley) if they argue otherwise, they are liable to be sued under the Trade Descriptions Act. Make them aware of this as part of your argument and they MUST supply you with what they are advertising. Hope this helps :)

Same as above - looks like an advert for the pair !!

Why the hell would you wanna buy one pulley unless its to replace a broken one which realistically aint gonna happen!

definately advertised as a pair...as in its sold in a pair and the quantity 1 means your gettin 1 set of pullleys

i would have read it as being for only one pulley but i see how it could be confused as a set

I've had two crack. But they were Skunk2, not Toda.

I have been in touch with them and they wont budge and are refusing to sort the situation out saying that, if i want another pulley, buy one". The payment was made thru paypal and they have since changed the advert on their site adding on a bit at the end that says "require 2". So what can I do now.

Really? IN & EX qty of 1.
How can you assume its for a single pulley when they are saying basically its for an intake AND exhaust pulley.
Though some might get confused with this simple concept. I suppose its my fault for not assuming the worst.
:secret: .......whats that........oh speed-demon is being sarcastic. :p

Try opening a PayPal dispute. And send them this thread too. They sound like a rubbish business, I'll be keeping away from them in future if this is how they treat their customers. It's bordering on fraud.

Best advice I can offer is gather the evidence you can (their website, the advert before and after if you can, this thread as the poll will be effective, and a copy of the Trade Descriptions Act outline that their advert is 'misleading and unclear') and send them this via a letter. Thell them that you have sought after legal advice and that if they refuse to cooperate, then you will take matters further. Also, ask them if they are so confident in their advertising techniques, why are they altering their advert? You would have a case hands down mate, trust :nice:

I would recommend advising them in a friendly but firm manner that their misleading advertising and uncooperative service attitude will be plastered all over the interwebz if they refuse to solve your problem at hand.

If they have any business talent, they will do the right thing.

Whatever the outcome, I would NEVER deal with them again. The fact that they went and changed the product description on their site says it all really...

It's one thing to make a mistake (we all do), but that's just going about sorting it the wrong way. If this sort of thing happens on such a small scale, I dare not imagine what other stunts this company may have up their sleeves. (Not saying they do!)

My 2 cents.

Good luck!

;)

Yeah the fact they have changed the advert says it all really.

Once they have read over it when you complained - they have clearly realised their advert was mis-leading and now changed it.

They are in the wrong 100%

They wouldn't have a leg to stand on if this was taken up with any governing body, by altering their advert they are accepting responsibility and accepting that it was misleading in the first place.

In your situation, an official-sounding letter can do wonders, informing them of your intentions to contact 'x' governing body and giving dates of the various happenings. If they have any sense they will give in immediately instead of being dragged through any potential legal proceedings.

Get in contact with the Advertising Standards Authority for the misleading advert and get in contact with the Trading Standards Institute for the fact they sold a mis-described item and are not willing to refund you for it.
