WTF do you guys make of this


Is it, in your opinion advertised as a set of pulleys, or just 1

I have been in touch with them and they wont budge and are refusing to sort the situation out saying that, if i want another pulley, buy one". The payment was made thru paypal and they have since changed the advert on their site adding on a bit at the end that says "require 2". So what can I do now.

Best advice I can offer is gather the evidence you can (their website, the advert before and after if you can, this thread as the poll will be effective, and a copy of the Trade Descriptions Act outline that their advert is 'misleading and unclear') and send them this via a letter. Thell them that you have sought after legal advice and that if they refuse to cooperate, then you will take matters further. Also, ask them if they are so confident in their advertising techniques, why are they altering their advert? You would have a case hands down mate, trust :nice:

it said Pulleys IN & EX Quantity x 1 ..... so you should get one IN and one EX... You have a strong case, dont give up on it! Get trading standards in as said and make sure you dont get swindled,

the very LEAST they should offer you is a full refund if you return the item (at their cost) :nice:

Ok guys a quick update on this. I have opened the dispute with paypal resolution center. This should change things a little. I have a copy of all emails sent to me and sent by me to Nengun should they require it. I am not happy with sending back the pulley. That would be the easy way out for them, even tho it would suit me better as I already had to get another set.
But its a matter of principal now. I'll keep you guys informed.
 
If it uses a plural to describe the item for sale, you are legally entitled to what they advertise, (which is more than one pulley) if they argue otherwise, they are liable to be sued under the Trade Descriptions Act. Make them aware of this as part of your argument and they MUST supply you with what they are advertising. Hope this helps :)

Surely this isnt exactly true? I'm no expert, but the most you will get here is a refund. They dont HAVE to sell you anything, If they admit they got it wrong in court or what ever, you may get a refund but I cant see you ever recieving the other part.

I do however, agree the advert is misleading, I would have thought you would be getting the pair reading that.

If you read the Trade Descriptions Act, you'll find it IS, yeah... No they don't have to provide you with the item after a dispute in court, but you obviously didn't understand what I was writing. I was putting it into general context, by which if they advertise something, they HAVE to provide what they are advertising to a tea, it's the law, so you're wrong! A half arsed advertisement won't suffice in any circumstance, I don't care what they say!
 
OK guys update here. Paypal has denied the claim. Here is what they had to say:

We have completed our investigation of this case. No further action is required by you at this time. We have denied this claim. As stated in our User Agreement, PayPal's Buyer Complaint Policy only applies to the shipment of goods, not to disputes about the attributes or quality of the goods received. We have noted your claim in the seller's record. The seller's account privileges will be limited if excessive complaints are received.

so what they are saying if the seller gets more complaints they will look into it, but will do shag all for me. ?

The seller emailed me saying he would refund me and pay the cost of shipping from Ireland back to Japan......but as this is not in paypals hands I dont trust him. He says he will only transfer the money when he recieves the part at his end. Leaving me sending back a cam pulley with a €30 or £25 postage fee with a risk I wont get a penny.

PayPal can be rubbish, especially when used outside of eBay. They've even put fees on Gifts now.

If I was in your position, I would take a picture of the cam-gear, photocopy any receipts they sent to you and include a letter outlining what has happened with some long words and what you want to happen with amounts and dates.

Then post it off recorded delivery.

There's not really much else you can do unless you want to buy the other pulley, especially if the company is registered only in Japan.
